About Kraken
Kraken is one of the longest-running cryptocurrency exchanges, founded in 2011 by Jesse Powell and operated by parent company Payward, Inc. It has been led since October 2024 by co-CEOs Arjun Sethi and David Ripley. Its Kraken Pro derivatives venue lists roughly 20 RWA perpetual contracts spanning xStocks tokenized stocks and ETFs such as Apple, Nvidia, Tesla, the S&P 500 and Nasdaq-100, a SpaceX pre-IPO contract (PF_SPCXXUSD), FX majors including EUR, GBP and CHF, and commodity products including WTI crude, silver and gold-token perps. The tokenized-equity perps launched in February 2026 with up to 20x leverage, the SpaceX pre-IPO perp listed on June 7, 2026, and FX perps launched in April 2025. Contracts are cash settled in USD on multi-collateral flex margin, with funding realized hourly on products such as the pre-IPO perp and headline derivatives fees of 2 bps maker and 5 bps taker. The venue is operated for non-US clients by Payward Digital Solutions Ltd, a Bermuda company licensed by the Bermuda Monetary Authority, with eligibility restrictions that exclude the US and, for some products, the EEA, Canada and Australia.

Regulation
The perpetual futures venue is operated by Payward Digital Solutions Ltd, which holds a Class F Digital Asset Business license from the Bermuda Monetary Authority (registration 202403268), while group company Crypto Facilities Limited holds a UK FCA authorisation including a Multilateral Trading Facility permission (FRN 757895) and Payward Europe Digital Solutions (CY) Limited holds a CySEC MiFID investment firm license (342/17) for EEA derivatives. In the EU, Payward Europe Solutions Limited received a MiCA CASP license from the Central Bank of Ireland in June 2025, and in the US, NinjaTrader Clearing LLC (acquired 2025) operates as Kraken Derivatives US, a CFTC-registered FCM and NFA member, alongside a Wyoming SPDI bank charter held by Kraken Financial. Kraken settled SEC staking-service charges for 30 million dollars in February 2023, and the SEC's November 2023 lawsuit alleging operation of an unregistered exchange was dismissed with prejudice in March 2025 with no penalties or admission of wrongdoing.
